Wrongful Death Lawsuit Filed Against CSX

A wrongful death lawsuit has been filed in New York State Supreme Court by the parents of a Blauvelt man who was killed two years ago by a CSX freight train.

In June, 2005, Christopher, 21, was killed when his vehicle collided with a freight train at the Erie Street crossing. The family’s lawyer contends he was likely blinded by the early morning sun glare and could not see or hear that the train was coming.

Police reports show the operator and engineer saw the vehicle approaching but did nothing to slow down or stop the train.

The lawsuit claims that CSX and their operators were “careless and negligent” and “failed to take preventive measures to avoid a collision with the defendant’s vehicle.” Additionally, the suit claims CSX should have more safety measures at the crossing.
